• Trade mark protection is governed by the Trade Marks Act 1976 and the Trade Marks Regulations 1997 for trademark and service marks in Malaysia.

 

 

• Courtesy renewal reminder notice is issued to the address for service on the Register, 3 months before the due date of renewal. However, failure to receive a reminder, for whatever reason, does not entitle you to any rights.

 

 

• The period of trade mark protection is 10 years from the date of application and renewable for a period of every 10 years thereafter.

 

 

    Helpful Hint: Avoid using the ® symbol if your trademark protection has ended. It is an offence under       the  Trade Marks Act 1976 and Trade Description Act 2011
