The patent protection in Malaysia is governed by the Patents Act 1983 and the Patents Regulations 1986. 

The Patents Act stipulates the term of protection:

 

• for a patent, upon grant, is 20 years from the filing date, subject to payment of prescribed annual fees. 

 

• for a Utility Innovation, upon grant, is 10 years from filing date and extendable for further 2 consecutive terms of 5 years each and subject to use and  payment of  prescribed annual fees.
